Statement Upheld Child protection 05-Sep-2024
Summary: Mr and Mrs X complain the Council was at fault in how it managed its child protection enquiry relating to their children following an incident in June 2023. We found the Council was at fault for delay in completing the Child and Family Assessment as well as the poor communication with Mr and Mrs X. The Council agreed to address the injustice its actions caused to Mr and Mrs X in line with our recommendations.

Summary: Mr X complained about how he has been treated by the Council. He said: staff are discriminating against him because of his homelessness and disabilities; the Council has not supported him properly because he does not have access to the services; the Council asked him to sign a tenancy agreement without having the chance to see the property and said the Council’s communication has been poor. We find the Council was at fault for failing to respond to some of Mr X’s emails. This caused him significant distress. To remedy this injustice caused by fault the Council has agreed to apologise.

Summary: Mr Y complains about the actions of the Council when it placed a young person into an emergency foster placement with Mr Y in late 2023. The Council was at fault for failing to consider Mr Y’s complaint under the children’s statutory complaints procedure. This meant Mr Y went to unnecessary time and trouble going through the Council's corporate complaints procedure and then complaining to the Ombudsman. The Council has agreed to complete the remedial actions recommended at the end of this statement.

Statement Upheld Charging 05-Sep-2024
Summary: Miss X complained the Council is chasing her brother for a Community Care charge debt. Miss X disputes the validity of the debt and says her brother did not receive the care charged for. We found fault with the Council charging for care since July 2017. We did not find fault with the Council charging for care up to this point. The Council agreed to apologise to Miss X and remove all charges from 1 July 2017. The Council also agreed to write to Miss X to confirm the outstanding balance owed and offer an arrangement to repay the remaining outstanding balance owed in instalments.

Summary: Mr X complained about the Council’s handling of his waste collection. The Council failed to consistently collect waste, failed to properly address the cause of this and kept poor records. These faults caused Mr X frustration and uncertainty. The Council will apologise and make a payment to Mr X to recognise the personal injustice caused to him. The Council will also review its processes.

Summary: There was excessive delay in finalising an Education, Health and Care (EHC) Plan after annual review and in consulting schools when a change of placement was recommended. The Council will apologise, make a symbolic payment to acknowledge distress and uncertainty, and carry out service improvements.

Summary: Mr Y complained on behalf of his mother, Mrs X. He complained about how the Council dealt with Mrs X’s non-residential care charges following her discharge from the hospital. There were some faults by the Council which caused injustice to Mrs X and Mr Y. The Council will take action to remedy the injustice caused.

Summary: Mr X complained the Council delayed processing his housing application and carrying out a medical assessment. He also complained about the Council’s decisions regarding his housing priority and restrictions on certain types of property. We have ended our investigation of Mr X’s complaint. The Council accepted faults in communication, complaint handling, and delays in processing Mr X’s application. It apologised, backdated Mr X’s housing priority, offered a suitable financial remedy, and offered Mr X a review of its decision on property restrictions. Further investigation by the Ombudsman could not achieve any more for Mr X.

Summary: Mrs H complains, that when the Council replaced a streetlamp bulb for an LED one, it removed the cowl that provided protection for them from the lamp’s glare. It then told her its policy was she would have to wait for eight weeks before asking it to fit a cowl. In response to my draft decision the Council has advised there was not a cowl on the old lamp. And that it has now fitted a cowl. My decision is there was no fault by the Council.
