Statement Closed after initial enquiries Homelessness 08-Sep-2024

Summary: We will not investigate this complaint about the Council’s decision on Ms X’s homeless application. There is insufficient evidence of fault in the Councils investigation of her case and it was reasonable for her to challenge the statutory review decision by appealing to the County Court.

  • Shropshire Council (24 006 571)

Statement Closed after initial enquiries Child protection 08-Sep-2024

Statement Closed after initial enquiries Council tax support 08-Sep-2024

  • Derby City Council (23 014 206)

Statement Upheld Special educational needs 08-Sep-2024

Summary: Ms Y complained about the way the Council dealt her child, Z’s special educational needs support and alternative provision. We have found fault by the Council, causing injustice, in failing to: complete Z’s educational health and care needs assessment within the statutory timescales; provide Z with a suitable education and monitor the delivery of Z’s first education, health and care plan. The Council has agreed to remedy this injustice by apologising to Ms Y, making payments to recognise the worry and distress caused and the impact on Z of the missed education, and service improvements.

  • Swindon Borough Council (23 015 852)

Statement Upheld Special educational needs 08-Sep-2024

Summary: Ms X complains about the Council’s decision to name a particular school on her child’s education, health and care plan. Ms X also complains the Council failed to provide her child with a suitable education when he was unable to attend school. Although we are unable to investigate some aspects of Ms X’s complaint due to them being outside of the Ombudsman’s jurisdiction, we have found fault with the way the Council communicated with Ms X and its record-keeping. The Council has agreed to remedy the injustice this caused.

  • East Riding of Yorkshire Council (23 016 108)

    Statement Upheld Charging 08-Sep-2024

    Statement Upheld Homelessness 08-Sep-2024

Summary: Mx D complains the Council failed to meet their housing and social care needs when they were homeless. They said, as a result they experienced distress and had a loss of care support. We found the Council’s Housing and Adult Social Care teams caused delays and faults in its processes. The Council will apologise and make payment to acknowledge the injustice Mx D experienced.

  • Bournemouth, Christchurch and Poole Council (23 017 915)

    Statement Upheld Charging 08-Sep-2024

Summary: Mrs X and Mrs W complain the Council failed to properly explain the charges for their late mother’s care home. They also say they were denied a choice of alternative care provider. There is evidence of fault by the Council, but this did not cause injustice to the family. Nevertheless, the Council needs to improve its working practices.
