Summary: Miss X complained about delays in the EHC Plan process and in issuing a final EHC plan which meant her son was unable to start school in September 2023. Miss X also complained her son is still not receiving an education or the provision specified in his EHC Plan. We find the delay in completing the EHC Needs Assessment and issuing a final Plan is fault. As was the failure to provide a full-time education. This fault has caused Miss X and her son an injustice.

Summary: Ms X complained about the handling of her Disabled Facilities Grant (DFG) application. She says the proposed adaptations to her property are not fit for purpose and do not create sufficient space for her family. Mrs X complained the Council did not consider her family holistically or take account of their social and emotional needs. The Council’s failure to demonstrate how it took account of Ms X and her children’s views and needs is fault. As is the delay in completing an assessment of needs. These faults have caused Ms X an injustice.

Summary: Ms X complained about the way the Council dealt with her child’s direct payments and that it failed to respond to her about this matter. The Council was at fault for not considering Ms X’s complaint through the statutory children’s complaints procedure. The Council will apologise, make a payment to Ms X for the distress and frustration caused and consider her complaint further.

Mr X said he was unable to bid for properties and has lived in unsuitable conditions for longer than necessary. We have found fault by the Council but consider the agreed action of an apology, symbolic payment, backdating the outcome of the application and a review to identify any missed bidding opportunities provides a suitable remedy.

Mr X said this will reduce the value of his home, will impact on his family and the community, and fears anti-social behaviour from the residents. We do not find the Council at fault.

The Council has agreed to apologise and make a symbolic payment to remedy the injustice caused by the faults identified.
