Summary: Mr X complained the Council delayed and made errors in respect of his homelessness application impacting his position on the housing register and causing distress. The Council accepts fault in not accepting the main housing duty when it had already determined Mr X was homeless by accepting the relief duty. The Council has now agreed a suitable remedy.

Summary: Mrs F complained about the Council’s handling of her son’s education since late 2021. We found the Council at fault for failing to provide all the provision set out in his Education, Health, and Care Plan since January 2024. The Council should apologise and make payment to acknowledge the injustice its faults caused Mrs F and her son. We could not investigate Mrs F’s concerns about her son’s education and her needs assessment requests from before December 2023 as the Council’s decisions carried appeal rights to the SEND Tribunal.

As a result, he was then too late to apply for rate relief. Mr X said this impacted him financially. There was fault in the way the Council registered the account to the wrong address initially. This fault did not cause Mr X an injustice.

Summary: Mr P complained about the lack of support he received from the Council when he was threatened with homelessness. We upheld the complaint, finding the Council failed to always follow the law and Government guidance, communicated poorly, and made mistakes in its handling of Mr P’s case. We consider this caused Mr P avoidable distress. The Council has accepted these findings and agreed to remedy Mr P’s injustice, with actions detailed at the end of this decision statement.

Summary: We cannot investigate Mrs X's complaint the Council did not name a school, or suitably consult with schools, when it issued an Education, Health, and Care Plan. Nor can we investigate her complaint the Council delayed providing alternative provision for her son when they were not at school. Mrs X has appealed the Council’s decision to the SEND Tribunal and her complaints are not separable from her appeal about the content of an Education, Health, and Care plan. Therefore, the law says we cannot investigate.

Summary: Ms X complained the Council offered her unsuitable temporary accommodation and delayed in responding to her reports about this. Ms X says this impacted on her mental health and she had to live in conditions which were unsuitable. We have found the Council at fault. To remedy the injustice caused to Ms X, the Council agreed to apologise and make a payment to Ms X to acknowledge the distress and hardship she experienced living in unsuitable accommodation.

Summary: Mr X complains the Council has failed to meet his son’s, Mr P’s, needs for care and support. The Council accepts it took too long to reassess his needs, and it changed his personal budget without giving four weeks’ notice. It apologised for the delay but not the lack of notice. The Council needs to apologise for the lack of notice and make a symbolic payment to Mr X for the distress caused.

Summary: Mrs X complains about the Council’s handling of her sons’ Education, Health and Care Plans after they moved into the Council’s area in summer 2023. She says that as a result her sons missed education and essential Special Education Support that they were entitled to. We found the Council was at fault for the delay in finalising the transfer process and for not keeping Mrs X informed about the progress of her complaint. The Council agreed to our recommendations on how to address the injustice its actions caused the family.
