Summary: We will not investigate this complaint about the Council refusing to consider and reply to a complaint on it not keeping to Mr B’s requested adjustments to its procedures and on it wrongly disclosing his personal information to his landlord. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. We have already decided complaints about events leading to the complaint and will not investigate the Council’s complaints handling separately. The Information Commissioner’s Office is best placed to consider complaints about information processing, and it would be reasonable to take any claim of disability discrimination to court.

Summary: Mrs X complains the Council issued multiple Education, Health and Care plans that named unsuitable placements and provisions, which meant her child was unable to attend education. The Ombudsman intends to find fault with the Council for its delay during the Education, Health and Care plan process, and for not communicating its decisions to Mrs X, however this did not cause significant injustice to Mrs X. The Ombudsman does not find fault with the Council for how it considered its alternative provision duty. The Council has agreed to apologise to Mrs X and carry out service improvements.

Summary: X complained about the Council’s failure to require that a developer create a footpath to make it suitable for walkers and cyclists. We found fault in the way the Council acted that resulted in it losing planning control of the path. We did not make any recommendations because the Council has already accepted the fault and made satisfactory improvements to its service.

Summary: Miss X complained about the Council’s management of her late mother’s (Mrs Y) charges for non-residential care. We identified one area of fault because the Council failed to confirm whether it intended to pursue Mrs Y’s estate for unpaid client contributions from 2019. This caused Miss X uncertainty and distress. To remedy this injustice, the Council has agreed to apologise and confirm its position about this matter in writing. We found no fault with the Council’s response to more recent unpaid invoices.
