Summary: Miss X complains that the Council failed to deal with pests and disrepair at her temporary accommodation and failed to support her with moving to another area. The Council took sufficient action to deal with Miss X’s complaints of pests and disrepair. But the Council is at fault as it delayed in moving Miss X to suitable temporary accommodation which meant she and her children lived in unsuitable temporary accommodation for two months. The Council is also at fault as it did not provide sufficient support to Miss X to help her move to another area which caused distress and uncertainty to her. The Council has agreed to remedy this injustice by apologising and making a symbolic payment of £700 to her.

Summary: Mrs X complained about the Council’s failure to rehouse her tenant from her property after she served a notice. We found the Council at fault as it did not consider whether the property was reasonable for the tenant to remain in occupation, during the period Mrs X was seeking possession of the property. The Council has agreed to our recommendations to remedy the injustice.

Summary: We have not reinvestigated Mrs Y’s complaint because it has already been subject to a thorough and independent investigation under the statutory children’s complaints procedure. We have also seen evidence to show the agreed recommendations have been implemented by the Council. However, the recommendations do not go far enough in remedying the personal injustice Mrs Y experienced from the fault and the Council has agreed to implement the remedial action in the final section of this statement.

Summary: There is no evidence the care provider failed to seek medical attention promptly or give a good standard of care to the late Mr X. The care provider acknowledges it did not always communicate with the family as it might have done but I am satisfied its apology and retraining was sufficient.

Summary: We found fault on Mr Y’s complaint about the appeal panel failing to follow proper procedure when it rejected his appeal against the Council’s decision, as admission authority, to refuse his son a place at his preferred school. There was a failure to show the panel properly considered the prejudice case and how it balanced this against Mr Y’s submissions. The agreed action remedies the injustice caused.

Summary: Mr X complains the Council made an error on his neighbour’s planning application which caused harm to his amenity. We found the Council had incorrectly approved a planning application that it would otherwise have refused. This was fault. It meant that Mr X’s amenity was affected. However, we found the Council had acted to prevent the problem reoccurring, made a genuine apology and offered compensation to Mr X which was in line with our guidance for remedying complaints. As a result, we found the complaint had already been remedied appropriately.

Summary: Ms X complained that the Council failed to investigate her concerns that her former partner was receiving funding for their child but was not using it for the child’s benefit. She also says the Council failed to act on her request to remove the child from the funding programme. We found the Council investigated Ms X’s concerns but failed to act promptly on her request to remove the child from the funding programme. The Council has provided a satisfactory remedy for the injustice caused.

Summary: Ms X complains the Council failed to provide a suitable education for her son when he was of compulsory school age. We found there was delay in finding a suitable placement by the Council and no alternative provision was made. There was also delay in issuing her son’s Education Health and Care Plan. We recommended an apology and payment to recognise the lost provision and distress caused.

Summary: Mrs E complained the Council caused and continues to cause, delays in the Education, Health, and Care needs assessment process for her daughter. The Council accepted it caused a service failure. It should make payment to Mrs E to acknowledge the injustice its delays have, and continues to, cause.
