Summary: Mr X complained on behalf of his daughter, Mrs Y. He complains about the delays in the education, health and care plan process, poor communication and lack of support. We find the Council was at fault for delays in the process and poor communication. This caused significant distress to Mrs Y and Mr X spent unnecessary time and trouble contacting the Council. The Council has agreed to make several recommendations to address this injustice caused by fault.

Summary: Miss X complained about the Council’s failure to rehouse her after her son had a serious injury. We have not found the Council to be at fault. It assessed Miss X’s transfer request in line with its published allocations policy. The delay in rehousing her was due a shortage of suitable three-bedroomed properties in the area.

Summary: Mr X complained the Council has repeatedly failed to collect his recycling on the scheduled days or in a timely manner when collections are missed. And that the Council has failed to properly investigate his complaints or address his concerns. The Council repeated failure to collect Mr X’s recycling as scheduled is fault, as was the failure to properly consider and respond to his complaints. These faults have caused Mr X and injustice.

Summary: We found fault on Mrs K’s complaint about the Council failing to allow her to bid for two-bedroom properties which left her in a property which does not meet her needs. It failed to show it properly considered her evidence when reaching its decision. The agreed action remedies the injustice caused.

Summary: Miss X complained the Council delayed completing her son, Y’s Education, Health and Care (EHC) needs assessment in line with statutory timescales. The Council was at fault. It delayed deciding whether to issue Y with an EHC Plan within the statutory timescale, caused by a seven week delay in obtaining Educational Psychologist advice. It then further delayed issuing Y’s final EHC Plan by 27 weeks after it received the EP advice. This caused Miss X distress, uncertainty and delayed her right of appeal to the SEND tribunal. The Council agreed to make a payment to acknowledge this injustice and explain what action it is taking to reduce the backlogs in the EHC needs assessment process.

Summary: Mrs B complained that the Council had failed to take enforcement action against development next door to her property and failed to notice that the certificates of ownership submitted with the original applications were wrong and the building work had encroached on her land. We have not found fault with the actions of the Council.

Summary: Mrs X complains that the Council failed to comply with the agreed action in the Ombudsman’s final decision for her previous complaint to source a domestic support provider for her. The Council took sufficient action to source a domestic support provider for Mrs X. But the Council is at a fault as it failed to consider if it needed to make reasonable adjustments for Mrs X to complete the paperwork for direct payments. This fault did not cause significant injustice to Mrs X.
