    Summary: The complaint is about the Council’s decision that it would not fund the fees for the care home the complainant was in. So she needed to move when the Council took over the care funding. Also that the Council did not give the complainant a choice of alternative care homes to move to. We see no fault in the way the Council arrived at its decision about the maximum care fees it would pay. It did only provide one alternative care home, but has explained why. We do not uphold the complaint.

This caused Miss X and Y distress, frustration and uncertainty. The Council has agreed to apologise, make payments, provide a timeframe for implementing provision and consider provision catch-up sessions for Y.

It did not complete a medical assessment soon enough, and it did not deal with Ms X’s complaint properly. This caused Ms X distress and uncertainty, but it is unlikely that she missed out on suitable accommodation. The Council has agreed to apologise for the impact on Ms X and make a symbolic payment to recognise the distress and uncertainty it caused her.
