Summary: The Ombudsman found fault by the Council with regards to the failure of a care agency acting on its behalf to provide an agreed care visit to a vulnerable elderly woman. The Council agreed to apologise for this and pay a financial sum to the woman and her daughter in recognition of the distress the fault caused them.

Summary: Ms C says the Care Provider failed to properly investigate when a carer acted inappropriately while providing respite care, failed to take action and stopped care without notice. The Care Provider’s communications with Ms C were not clear, although it upheld her complaint and took action. The Care Provider stopped care without notice and was unclear in its communications about respite care. An apology, payment to Ms C to reflect her time and trouble and distress, discussion of a payment to reflect damage to a carpet and belongings and commitment to provide notice when stopping care is satisfactory remedy for the injustice caused.

Summary: the complainant says the Council’s care contractor failed to provide the care for her parents set out in their care plans. This resulted in carers leaving the couple soiled, in soiled clothes and lacking dignity. The Council says its contractor did fail to provide care to the standard expected and it followed up the faults with the contractor. The Council offered the family advice on how to engage care direct. The Ombudsman finds the Council at fault for the failings in the care provided and lack of significant improvement.

Summary: There was fault in the care the agency, commissioned by the Council, provided to Mrs D. The Council also delayed providing Mrs D with a suitable chair to sit in and it did not follow the correct process in restricting Mr B’s contact with the Council. The Council has agreed to apologise in writing, pay a financial remedy for the provision of poor care and the delay in providing the chair. The Council will also review its decision to restrict Mr B’s contact with the Council and review its letter restricting contact.

Summary: Mr X complained the Care Provider, Comfort Call, commissioned by the Council did not properly care for his mother and would not respond to his queries. He also disagreed with an investigation carried out by an independent investigator into his complaint. He said this caused his mother distress and put him to significant time and trouble. There was no fault in the Council’s actions.

This caused Ms C avoidable distress and inconvenience. To remedy the injustice, the Care Provider should apologise, make a symbolic payment of £100 and review its standard information to include advice to customers about notice periods when it wants to end a service.
