Summary: Miss X complains the council failed in its duty to provide alternative provision to her son Y. We have concluded our investigation having made a finding of fault by the Council. I found the Council failed to provide sufficient alternative provision to Y when he was not attending School A between January 2022 to March 2022. This caused an injustice to Y, and I have proposed recommendations to the Council.

Summary: Ms X complained about the Council’s actions regarding her homelessness application. She complained the Council did not properly consider her request on medical grounds for an additional bedroom, delayed responding to her complaint, did not respond to her request for an additional bedroom, and initially suspended her application to join its choice-based lettings scheme. We found fault by the Council and the Council has agreed a remedy to address the injustice identified.

Summary: Mrs X complains the Council failed to correctly follow child protection procedures, providing inaccurate and unverified information to the Initial Child Protection Conference. She also says the Council did not properly investigate allegations from family members. We have found the Council at fault for the delay in completing the statutory children’s complaints procedure. We have also found the Council acted with fault by not fully addressing the avoidable distress and uncertainty its actions caused Mrs X. We have made recommendations to remedy the injustice caused.

Summary: Miss X complained about the way the Council handled her son’s special educational needs, including providing all the provision set out in his Education, Health and Care plan. Miss X said the missed provision had an impact on her son, and it caused her unnecessary distress and frustration. We find the Council at fault and this caused injustice. The Council has agreed to apologise.

Summary: Ms X complains about the Council’s failure to provide adequate education to her child, Y, since they were admitted to hospital and unable to attend school fulltime. The Council failed to ensure Y received suitable alternative education provision since the end of June 2022. The Council has agreed to apologise, make payments to Ms X for distress and Y for missed education, and assess whether it still owes an alternative provision duty to Y. The Council will also review its procedures and provide further guidance or training to relevant staff.

Statement Upheld Special educational needs 26-Jan-2024
Summary: Mrs B, complained the Council did not secure suitable education or education, health, and care provision for her son. Mrs B says because of this, her son did not take any exams and did not gain any qualifications. We found fault with the Council for failing to secure the speech and language provision in her son’s education, health, and care plan. Because of this fault, Mrs B’s son missed provision. The Council will apologise to Mrs B and her son for this fault and backdate his personal budget to make up the missed speech and language therapy.
