Summary: Mr D complained about the Council’s decision to remove a camera he had installed in his son’s room in the care home where he lives. We found it was fault not to take a best interest decision about this. But this fault has not caused injustice to Mr D or his son as it is likely the decision would have been for the camera to be removed.

Summary: the Council gave Mrs B wrong information about her options when she contacted the Council about a penalty charge notice, failed to consider alternative options in light of Mr B’s vulnerability and delayed telling enforcement agents about the circumstances. An apology, agreement to take the debt back from the enforcement agent and consider a payment plan, payment to Mrs B, training for officers and amending the Council’s vulnerability policy is satisfactory remedy.

Summary: We found fault on Mr J’s complaint against the Council about its failure to take enforcement action against a neighbour who did not comply with planning consent. While there was some delay, this caused no significant injustice.

Summary: There was no fault in the way the Council decided to offer Mr E temporary care at a care home or its attempts to find extra care housing for Mr E. The Council should have informed the family sooner that the care home placement had become permanent but this would not have made a difference to the outcome. There was no fault in the Council’s communications with the family, except that there was no record that the Council told the family what the care home’s rate was during an initial conversation. The Council has agreed to reduce the outstanding debt by the equivalent of two weeks’ contribution.

Summary: Ms X complains the Council was at fault in the way it dealt with her need to move from her temporary accommodation after the Council decided it was unsuitable for her and her family’s medical needs causing distress. We found fault because the Council has not provided Ms X with suitable temporary accommodation, and we have made appropriate recommendations. So, we have completed our investigation.

Summary: The Council accepted fault for its delay issuing an amended Education Health and Care plan following an annual review in June 2021. As a result, Child B missed three terms of Speech and Language Therapy. The Council has agreed to arrange extra provision to make up for this missed time, pay Child B £1,500, and act to improve its services.

Summary: Mr X complained that the Council’s school admissions appeal panel did not properly consider his appeal for a place for his child at his preferred secondary school. We found no fault by the appeal panel. However, we found the Council was at fault in that its website did not clearly explain the boundary of the school’s catchment area. This did not cause Mr X an injustice, but the Council has agreed to make the information on its website clearer for the benefit of future applicants.

Summary: Ms B says a local Councillor breached the Member’s code of conduct and the Council failed to properly investigate that. There is no evidence of a breach of the code of conduct and the Council dealt with the matter properly. However, it should have explained its decision there was no evidence of a breach of the code of conduct to pursue in more detail. An apology and reminder to officers is satisfactory remedy.

Summary: Miss X complained that the Council housed her and her family in unsuitable temporary accommodation. Miss X said there were no cooking facilities, which had a disproportionate effect on her partner’s physical health because he has diabetes. She said some days the family did not eat at all because of the cost, and it put them in debt. Miss X also said this exacerbated her partner’s mental health, and had an impact on her mental health. We find the Council at fault, and this caused the family injustice. The Council will apologise and make a payment to Miss X to reflect the injustice.
