    Summary: There was fault by the Council. It wrongly closed a noise complaint and then delayed visiting the supermarket complained about for one month. From this point onwards, there was no fault in the Council’s investigation. An apology and a payment, remedies the distress caused.

    Summary: Miss X complained the Council placed her in housing application band C. She said being in band C meant she would not get a two-bedroom property she needs. Miss X has complained to the Council since the birth of her second child in 2020. She said her property is overcrowded and causing her distress. There was fault in the way the Council did not respond to Miss X, but this did not alter the decision the Council made. Miss X did not suffer any injustice because of this fault.

    Summary: Mr X complained the Council wrongly removed and destroyed his car. Mr X says the Council has accepted fault but its offer of £1,000 falls short of the amount he is seeking. The Council has agreed to award Mr X £903.91 for his quantifiable loss and £200 for his distress, time and trouble caused by the Council’s fault.

    Statement Upheld Antisocial behaviour 27-Apr-2023

    Summary: Ms C complained the Council failed to take sufficient action to help tackle disturbance she is caused by a neighbour in an adjacent flat. This followed the Council having agreed in April 2022 to undertake a review of the case following an earlier investigation by this office. We upheld the complaint, finding fault in how the Council carried out aspects of the review. We found this caused Ms C further avoidable distress. The Council accepts these findings. At the end of this statement, we set out the actions it has agreed to remedy this injustice.

    Statement Upheld Parking and other penalties 01-May-2023

    Summary: Mr X complained the Council issued him with a Penalty Charge Notice and towed and impounded his car without proper cause. The Council was at fault for failing to record Mr X’s car details correctly. The Council has already apologised to Mr X and cancelled all charges, and this is sufficient to remedy any uncertainty and distress this caused.

    Summary: The Council wrongly prevented Miss B from bidding for properties on its housing register and made direct offers of properties which were unsuitable. It also failed to carry out a medical assessment after Miss B said that she was disabled and her accommodation was unsuitable for her needs. The Council has agreed to apologise, make a payment to Miss B, offer Miss B the next available suitable property and take action to prevent similar failings in future.

    Summary: Mr X complained the Council refused to arrange an occupational therapy assessment of his home. The Council failed to properly respond to Mr X’s request for an occupational therapy assessment and poorly communicated with him. The Council agreed to apologise and pay Mr X a financial remedy.

    Summary: Housing and adult social care failed to work together to assess the needs of an elderly woman with health problems who was homeless. The departments failed to carry out appropriate housing and social care assessments within a reasonable timeframe or issue written decisions. This caused avoidable distress, time and trouble and a loss of reablement care. The Council will apologise, make symbolic payments, provide housing advice and introduce procedures for joint working between housing and adult social care.

We find the Council at fault for providing inaccurate information, but we find it has already taken suitable action to remedy this.
