    Summary: Miss B complained about the Council’s decision to charge her the empty property premium for a property she owns. She says the Council removed the premium, and then reversed its decision a week later. She also says the Council refused to investigate a missing payment. The Council was at fault for wrongly advising Miss B it had removed the premium. The Council apologised to Miss B for the inconvenience caused. This is a suitable remedy for the injustice caused by fault.

This is because investigation would not achieve anything significant in addition to the remedy the Council has already offered.

The Council accepts there were inaccuracies in the report for the case conference and has taken action to remedy this. However, we cannot say this resulted in the wrong decision being reached.

    Summary: There was fault by the Council, because an accommodation managing agency, acting on its behalf, unlawfully evicted the complainant from her property. However, the Council has already taken positive steps to address the injustice caused by the illegal eviction. We have therefore completed our investigation.
