    Summary: there was fault in the way the Council considered Miss X’s request for a review of the decision not to award her additional preference on the Housing Register. There was further fault when the Council failed to consider the suitability of her temporary accommodation after Miss X and her solicitor reported the impact of damp and mould on her and her daughter’s medical conditions. These faults caused Miss X distress, uncertainty and denied her the opportunity to exercise her review rights. The Council has agreed to provide a suitable remedy.

    Summary: Mrs X complained the Council wrongly refused her application for school transport to the school named in her son’s Education, Health and Care Plan. The Council failed to correctly consider the application. The Council will take action to prevent the fault reoccurring, apologise to Mrs X and make payment to recognise the frustration caused and transport costs.

    Summary: There was fault in how the Council dealt with Mr X’s housing situation. It did not address his complaints about discrimination and it did not have proper regard for its duties under the Equality Act 2010. The Councils shortcomings caused Mr X significant distress and is likely to have increased the time he spent in unsatisfactory accommodation. I have recommended the Council take action to remedy the injustice caused to Mr X and to improve its services.

    Summary: Mrs D says the Council failed to make checks after receiving her representations challenging a penalty charge notice (PCN). We found evidence of fault by the Council, upheld the complaint and completed the investigation. The Council has accepted fault and agreed to cancel the PCN and pay Mrs D for her time and trouble.

We have found fault with some of the Council’s actions, primarily around poor communication with Mr X’s family. To remedy the distress and frustration caused by this fault, the Council has agreed to apologise, make payments to Mr X and his daughter and take action to improve its service.

We have found fault in the Council’s complaint handling but consider the apology and payment already offered provides a suitable remedy.
