Summary: Mr F complains his son, B, has been out of education for three years. The Council offered alternative schools in 2021, but appears to have ‘lost control’ of B’s education when it failed to review his Education, Health and Care (EHC) Plan in May 2021. The Council then failed to follow up the plans it made to fund support in the home. B has been without suitable education for four terms as a result.

Summary: We will not investigate this complaint about delays in the Council finding a school placement for Miss X’s son. She says her son has received no education or special educational provision since moving to the area. This is because the Council has agreed to resolve the complaint early by providing a proportionate remedy for the injustice caused by the faults accepted.

Summary: Mrs B complains about nursing care provided to her mother Mrs C by the Nursing Home, about information the Council gave her about nursing home options, and how the Council handled a safeguarding referral. The Nursing Home has already taken some action to prevent recurrence, apologised to Mrs C and her family, and waived its fees. We found the Nursing Home did not keep detailed records about taking a urine sample, leaving Mrs B with uncertainty over what happened during this time. We also found the Council did not communicate clearly with Mrs B about safeguarding, and a delay in sending her the provider enquiry report. This meant Mrs B missed an opportunity to raise her concerns at the time. The Council and the Nursing Home have agreed to take action to address the injustice.

Summary: There was fault by the Council. There was delay in carrying out an Education, Health and Care plan needs assessment. A child, Y, who could not attend primary school for 18 months had almost no education during this time. Y now has a place at a new school and is accessing some therapeutic educational provision. A payment recognises the service failure and distress caused to Mrs X.
