    Summary: We will not investigate this complaint about adult social care in a residential care home, because we are satisfied with the actions the Council has taken. The Council has found the Care Provider acting on its behalf was at fault, has apologised and offered the complainant a distress payment, and has taken action to improve service. The Ombudsman would achieve nothing further.

    Statement Upheld Enforcement 09-Oct-2023

    Summary: Mr X complained that the Council failed to properly investigate his concerns about breaches of planning permission at a neighbouring development. We found no fault in the way the Council dealt with these concerns. However, it failed to keep a note of all telephone conversations on the case record, causing uncertainty. It also failed to respond to Mr X’s queries causing uncertainty and frustration and putting him to the inconvenience of having to chase for updates. The Council has provided a satisfactory remedy for the injustice caused.

    Summary: The Council was not at fault for how it dealt with Mr B’s reports of noise from a neighbouring skate park. It properly considered the impact on Mr B and acted in line with relevant legislation. It was, however, at fault for a later delay in responding to Mr B’s emails. But it has already apologised for this delay, so no further action is needed.

    Statement Upheld Special educational needs 10-Nov-2023

    Summary: Ms X complains the Council failed to review and update her Education, Health and Care (EHC) Plan for many years. She says she wanted to return to education last year but was unable to because her EHC Plan was not up to date. The Council accepts it made mistakes and has offered to provide support to allow Ms X to complete the course even though she will be over 25. This is a good outcome.

    Summary: We will not investigate this complaint about poor residential care. The Council has completed a safeguarding investigation and made recommendations to improve practice at the Care Home. It has written to the complainant and apologised for any faults identified. We could not add to the Council’s investigation.
