The repeated failure to collect Mr X’s household waste and recycling or to return the empty bins to the collection point is fault. This fault has caused Mr X an injustice.

    Summary: The complainant (Mr X) said the Council failed to deal effectively with his reports of the anti-social behaviour (ASB) taking place in the alleyway next to his house. We found fault with the Council for not providing Mr X information on the Community Trigger process and for not making this information available in the Council’s leaflets about ASB. This fault caused Mr X injustice. The Council agreed to apologise, provide Mr X with the information on its Community Trigger process and amend its leaflets.

    Summary: We have upheld this complaint because the Council was at fault in delaying its response under the statutory process for complaints about children’s services. The Council has agreed to resolve the matter by providing a suitable remedy for the injustice the complainant has been caused.

    Summary: There was some minor fault in how the Council dealt with Mr X’s correspondence when he said he was no longer liable for council tax. It caused a slight delay and asked him for some information which it already had. However, it has already remedied his injustice by apologising.

    Summary: Miss X complained the Council incorrectly issued penalty charge notices to her partner, Mr Y, for driving in a Clean Air Zone. The Council was at fault for issuing Mr Y PCNs for a vehicle not owned by him, and continued to do so for a period after Mr Y had highlighted the problem. The Council has already apologised and has agreed to pay Mr Y £100 for the inconvenience, frustration and his time and trouble.

    Summary: We will not investigate this complaint about serious child protection failings by the Council when Mr X was a child. The Council has already accepted the full complaint of several serious failings over a long period, and that its complaint handling was inadequate. It has offered a remedy similar to that we would have recommended had we investigated and upheld the same matters. Investigation by us would therefore be unlikely to lead to a different outcome, or to a significant sum of compensation, which would be for a court to determine.

    Summary: Mr X complained the Council repeatedly failed to collect his household waste and recycling on the scheduled days or in a timely manner when collections were missed. He also complained he has not had an explanation for the missed collections or been notified by the Council of a change in presentation point for his bins. The Council’s failure to properly address the issue of restricted access and to ensure household waste and recycling could continue to be collected from Mr X’s street as scheduled is fault. As is the failure to communicate with residents regarding any changes to the waste collection service. This fault has caused Mr X an injustice.

    Summary: Mrs X complained that although she should receive assisted collections, the Council has repeatedly failed to collect her recycling. The failings in the assisted collection service the Council provided to Mrs X are fault. This fault has caused Mrs X an injustice.

    Statement Upheld Homelessness 01-May-2023

    Summary: Miss X complained about how the Council managed her homelessness application and temporary accommodation during 2022. The Council was at fault. It failed to carry out a suitability assessment when it provided her with temporary accommodation which was unaffordable. It meant Miss X remained in unsuitable temporary accommodation for 9 months. It also failed to provide her with a housing officer and a personalised housing plan. The Council agreed to apologise to Miss X and provide her with a payment to acknowledge the time spent in unsuitable accommodation and the distress and uncertainty that caused.
