Summary: We cannot investigate this complaint about a parking penalty charge notice as this matter has been before a tribunal and is no longer therefore within our legal remit.
The complaint
- Mrs X complains about a parking penalty charge notice (PCN) which was issued for parking outside her home when Mrs X thought she had a resident’s parking permit in place. Mrs X is unhappy about the cost of the PCN.
The Ombudsman’s role and powers
- The Local Government Act 1974 sets out our powers but also imposes restrictions on what we can investigate.
- We cannot investigate a complaint if someone has appealed to a tribunal or a government minister or started court action about the matter. (Local Government Act 1974, section 26(6), as amended)

My assessment
- Mrs X appealed the PCN to the Traffic Penalty Tribunal (TPT) and as such, we no longer have the legal remit to investigate.
Final decision
- We cannot investigate Mrs X’s complaint because It is no longer within our legal remit to do so.
