Even after a Tribunal decision, the Council did not put in place provision. We uphold the complaint. The Council has agreed to our recommendations of remedies for Miss P’s injustice.

Based on current evidence the Council is at fault because Mrs X had to spend longer than she should have in bed and breakfast accommodation, and it has delayed a financial remedy. Mrs X has suffered avoidable distress and financial loss. The Council should apologise, pay Mrs X the financial remedy agreed and review its policies.

Summary: There was fault and delay by the Council in failing to update Education, Health and Care plans after annual reviews and failing to ensure a child received suitable fulltime education over several years. There was also fault in the complaint handling and poor communication. This caused loss of education and unnecessary distress, uncertainty, time and trouble to the family. The Council will apologise, make symbolic payments, and service improvements. The complaint is upheld.

Summary: We have found fault by an NHS Trust, a Council and an NHS ICB for not allocating a care coordinator to someone who is entitled to one. The situation has caused avoidable uncertainty and distress. The organisations have agreed to provide an apology and small financial payments and to take steps to find a bespoke solution and work to resolve the wider issues.
