    Summary: We will not investigate Miss X’s complaint about delays in the Education Health and Care Plan process. This is because the Council has agreed to apologise to Miss X and pay her £100 per month for the delay. We consider this an appropriate remedy and further investigation is therefore unlikely to achieve anything more.

We found there was a failure to promptly deal with a housing application when submitted in March 2023 and there was significant delay responding to the complaint. We recommended an apology, backdating the priority date of her housing application, and a payment to recognise the distress and frustration caused.

    Summary: The Council is at fault for the way in which it banned Mr & Mrs X from visiting their daughter, Ms Y in her supported living accommodation for almost a year. It failed to investigate allegations against Mrs X fairly and failed to consider the impact of the ban on Ms Y. It also failed to conduct a mental capacity assessment of Ms Y in line with legislation.

    Summary: The care home commissioned by the Council failed to keep proper records and failed to carry out a thorough assessment before Mr B was admitted. As a result, it did not identify that Mr B had difficulty using his hands, and he sustained a burn to his leg when he spilled a cup of hot tea. The Council has agreed to apologise and make a payment to Mr B. It will also ensure the care home makes service improvements.

    Summary: We cannot investigate this complaint about damage caused by leaks into a private home from a Council property. We have no jurisdiction to investigate complaints about social housing landlords. We will not exercise discretion to consider Mr X’s complaints about leaks and anti-social behaviour from 2017 onwards. This complaint was received outside the normal 12-month period for investigating complaints. There is no evidence to suggest that Mr X could not have complained to us sooner.

    Summary: Mrs X complained the Council failed to deliver the social care support in Section H of her child’s Education, Health and Care Plan. The Council has accepted fault for failing to deliver this provision. The Council agreed to pay Mrs X the equivalent cost of the 6 hours of Personal Assistant Section H provision missed from 7 July 2020 to January 2024, excluding during the Covid-19 pandemic national lockdown from 6 January 2021 to 8 March 2021. The Council also agreed to pay Mrs X the equivalent cost of the 2 days per week for 8 weeks of the year playscheme Section H provision missed from 7 July 2020 to 31 March 2022. And, the Council agreed to apologise to Mrs X and pay her £1,000 for the risk of harm to Y through the failure to secure this Section H Education, Health and Care Plan provision and £500 for the time and trouble caused.

    Summary: Mr X was a foster carer for his brother. He complained about the support he received when his brother made allegations against him and the Council ended his fostering payments. There is no fault in the support offered or the Council’s decision to end his fostering payments.

    Summary: Mrs X complained about her late husband’s care and the way the staff at the Ashleigh Manor Residential Care Home treated her when she visited him. Mrs X complained the Care Home failed to recognise her status as Mr X’s wife. We found the Care Provider’s failure to keep detailed records regarding Mr X’s care and follow proper process regarding safeguarding concerns and decisions taken in Mr X’s best interest amount to fault. As do the Care Home’s failings in its communications with Mrs X. These faults have caused Mrs X significant distress and upset.

    Summary: Mr F complained the Council ignored his concerns about the school transport for his son who has special educational needs. There was fault which caused uncertainty and for Mr F to miss out on a personal travel budget. The Council has agreed to make payments to remedy this injustice.
