Summary: Mrs W complains on behalf of her late mother, Mrs Y, about the standard of care and support she received whilst at Oakham Grange Residential Care Home. In particular, she says the home did not appropriately manage and administer Mrs Y’s medication, did not ensure staff used safe moving and handling techniques and failed to monitor her weight and nutritional needs. The local safeguarding authority investigated the concerns and concluded with findings of neglect and organisational abuse. It made several recommendations for service improvements. The care provider will also apologise to Mrs W and make a symbolic payment in recognition of the uncertainty and distress caused by the failures.

Summary: We will not investigate this complaint about Miss X’s housing application. The complaint about the Council’s decision in 2018 is late without good reason to investigate it now. Nor could we reach a clear enough view on this point now. There is no fault in the waiting time priority the Council is giving the application now. It would be disproportionate to investigate the Council’s complaint-handling in isolation. There is no fault in the Council expecting Miss X to bid for properties rather than directly offering her a property.

Summary: Mrs X complained the Council delayed issuing her child, Y’s Education, Health and Care (EHC) Plan and then failed to ensure they received the provision in the plan from July 2023 until May 2024 after it named an inappropriate school. The Council delayed issuing Y’s final EHC Plan by five months. It agreed to apologise and make a payment for the injustice that caused. Mrs X appealed the content and named placement in Y’s EHC Plan to the SEND tribunal therefore I cannot investigate the period July 2023 until May 2024 as it falls outside our jurisdiction.

The care provider now agrees to apologise to Mrs A, provide evidence of the improved standards, and offer a sum in recognition of the anxiety caused to Mrs A.

Summary: Mrs X says the Council has failed to issue her son, Y’s final Education, Health and Care Plan in line with the statutory timescales. Mrs X also says the Council failed to liaise with her preferred school and gave incorrect information about being unable to contact the school. Mrs X says this case her and her family distress. We have found fault in the actions of the Council for delaying in issuing the Education, Health and Care Plan and delaying in contacting Mrs X’s preferred school. The Council has agreed to apologise to Mrs X, pay her a financial payment and complete service improvements.
