    Summary: Miss X complained the Council failed to finalise and issue her son’s EHC Plan following the annual review meeting held on 21 April 2023; provided zero hours of social care from December 2022 and failed to provide OT from June 2023. Miss X says this has caused stress and frustration and her son has missed out on the appropriate help. The Council took more than a year longer than it should to complete the annual review, has provided no social care since January 2023 and no OT since June 2023 which is fault. A suitable remedy is agreed.

    Summary: Mr X complained about how the Council had handled his housing application. He said the Council delayed processing his request for a medical assessment; the Council failed to properly consider his medical evidence; the Council’s communication has been poor, and the Council has failed to provide him with the right support. We find the Council was at fault for the initial delay in arranging a health assessment. This caused significant distress to Mr X. The Council has agreed to apologise and make a symbolic payment to address this injustice caused by fault.

    Summary: Miss X complains the Council did not properly review her child D’s Education, Health, and Care Plan and ensure it was suitable for them. There was fault by the Council which caused avoidable distress to D and Miss X, and uncertainty about what special educational needs provision D may have missed. The Council agreed to apologise, agrees a dated action plan with Miss X of next steps for updates to D’s Education, Health, and Care Plan, and pay a financial remedy. It will also make an action plan of how it will avoid recurrence of the same faults and report this to its SEND Governance Board for monitoring.

The complaint has been properly investigated as part of the statutory complaints procedure and there is no evidence of procedural fault in that process. The Council properly considered the findings and recommendations and so the Ombudsman will not consider this matter further.
