Summary: Mr B complained how the Council handled his application to rejoin the housing register. He says the Council has not properly considered his medical evidence and mobility issues, and it has taken too long to complete its review. He also complained the Council has failed to provide him with adult social care support despite his repeated requests. We find the Council was at fault for its significant delays in dealing with Mr B’s review request. It was also at fault for how it handled Mr B’s requests for adult social care support. The Council has agreed to our recommendations to address the injustice caused by fault.

Summary: The Council delayed in completing Mr X’s support plan following a Care Act assessment, failed to advise him at the outset that direct payments could not be used to pay a relative to act as his personal assistant because she was living in the same household and reversed its agreement to backdate direct payments. In recognition of the injustice caused, the Council has agreed to make a payment to Mr X and his family.

Statement Upheld Enforcement 19-Sep-2024
Summary: X complained about the Council’s failure to take planning enforcement action against their neighbour, who carried out developments on the land next to X’s home in breach of planning controls. We found fault because of unreasonable delay in taking enforcement action. We also found service failure because the Council cannot access some of its enforcement records due to building safety problems. The Council has agreed to our recommendations. It will carry out service reviews so it can avoid the fault recurring and to plan for how best to deal with the service failure.

We found fault, but it was not necessary to make any further recommendations beyond the remedy already offered by the Council. This was because the Council should not be held solely responsible for what had happened.

Summary: Ms X complained about how the Council handled her son, Y’s Education, Health and Care (EHC) Plan and education since 2020 and how it considered her complaints about those matters. The Council delayed issuing Y’s amended EHC Plan after an annual review meeting in December 2022 and its complaint response was unclear. The Council will apologise to Ms X for the uncertainty and frustration caused to her and pay her a symbolic amount of £300. The Council will remind its staff to act in line with the timelines set out in statutory guidance for EHC Plans.
