Statement Upheld General practice 01-Mar-2022
Summary: We found fault by a care home acting on behalf of the Council regarding the care it provided to Mr X, an elderly man with complex care needs. We found the care home failed to support Mr X and his wife, Mrs X, to make an informed choice about his GP registration. We also found the care home failed to administer palliative medication to Mr X as prescribed. In addition, we found fault by the Practice as it failed to discuss Mr X’s end of life management plan with Mrs X. These failings caused Mrs X distress. The Council and Practice will apologise for this fault and take action to prevent similar problems occurring in future.

Summary: Mr B and Mr C complain about the care their late mother Mrs D received from a Council-funded care home, from district nurses and from a mental health outreach team. They also complain the Council delayed re-assessing her needs. We found the Home failed to properly manage Mrs D’s leg condition and her continence needs. The Home and Council delayed too long in arranging to re‑assess Mrs D’s care needs. Mrs D is likely to have suffered preventable harm and distress due to these faults. The Council has agreed to apologise to Mr B and Mr C for the distress they have suffered, and to work with the Home to make service improvements. We did not find fault in Mrs D’s care from the district nurses or mental health outreach team.

Summary: Mrs Y and Ms Z complained about funding for their mother, Mrs X’s, residential care and the response to an injury to Mrs X’s hand. We have upheld the complaints against the Council and recommended remedies. We have not upheld the complaint against the NHS Clinical Commissioning Group. The Council accepts our recommendations. We have therefore completed our investigation.

Summary: Mr E has complained about the mental health and social care of his sister, Mrs F, by the Council and Trust. We find fault with the mental health and social care of Mrs F but not with her mental health assessment or the Trust’s complaint handling. The Trust and Council agreed to apologise to Mr E and take action to prevent similar problems in the future.

Summary: Mrs A complains on behalf of her niece, Mrs B, that she was wrongly charged for care home fees. During our consideration of the complaint, the Council told us there had been an error on Mrs E’s account. The Council has apologised and offered to refund £2145 to Mrs B. This provides the remedy Mrs A is seeking and therefore we will not investigate the complaint.
