It would therefore be disproportionate for us to investigate any Council delay in its handling of the matter. If a nearby Council-owned tree is found to be the cause of Mrs X’s property damage, this would be a claim that the Council is liable for it. It would be reasonable for her to make a claim to the Council’s insurer, then go to court if required, to pursue the legal liability finding of property damage and redress she seeks.
